Constitutional Study of PTA Yogyakarta to Indonesian Constitutional Court

Jakarta, pta-yogyakarta.go.id (Wed,18/02/10)  - The Constitutional Court practice in the Republic of Indonesia came from the accumulation of legal and political issues in the new order era, in which many law products at the time were problematic / not necessarily true, but there was no door to test and improve these laws through the judiciary agency.

Validation of a law products in the New Order had to go through the approval of the Executive agencies, in this case the President. Presidential power that could annul law products legalized by legislative Parliament was considered to be too large and tended to be arbitrary. This awakened constitutional awareness of Indonesian people to provide the balance of the legislative that was judiciary institution that could examine the law (judicial review). So in 2003 stood Constitutional Court of Indonesia as a State High institution in charge of examining the Act against the 1945 Constitution.

Those were described by the Chairman of the Constitutional Court, Prof. Dr. Moh. Mahfud MD, Responding to the request of the Chairman of PTA Yogyakarta to explain the history and background of the establishment of the Constitutional Court when receiving the visit of PTA Yogyakarta delegation in the Constitutional Court of Yogyakarta, Jakarta, on Thursday February 18, 2010.

It was an honor for PTA Yogyakarta, on his busy schedule, the Chairman of the Constitutional Court took himself to meet the PTA Yogyakarta delegation.

"I also have a sense of emotional bond with Yogyakarta, as well the religious court, because once I went to PHIN (Education of State Islamic Judge - red), which was known as the school to educate candidates for the religious court's apparatus," said the friendly Chairman of the Constitutional Court opening a greeting.

The delegation of the PTA Yogyakarta consisted of the Chairman, High Judges and registrar/Secretary of High Religious Court of Yogyakarta, Chairmen, Vice Chairmen and Registrars/Secretaries of PAs throughout Yogyakarta special Province had chance to visit  to the Constitutional Court of Republic of Indonesia prior to attending the coordination meeting of Chairmen and Registrars/Secretaries of High Religious Courts entire Indonesia which would commence tonight, and then to attend the National Seminar on Material Law of Religious Judicature next day (Friday, 19/02/10).

Arriving at the Constitutional Court at 13.00 pm, delegation was welcomed by the Constitutional Court, Drs. Fadlil Sumadi, SH., MHum. with wife, and the Constitutional Court’s employees. While waiting for the Chairman of the Constitutional Court who had the kindness to personally meet with the delegation, Fadlil Sumadi invited delegation to look around his office and the rooms in the Court. After lunch, at 13:45, accompanied by Chief Secretary of Court, Chairman met with the delegation in the Conference room of the Constitutional Court.

One-hour meeting with the chairman of the Constitutional Court run in relaxing atmosphere and full of familiarity. In a question and answer session, some participants enthusiastically asked the questions about the constitution which were directly answered by the Chairman of the Constitutional Court. As for question about the publication of decision of the Constitutional Court asked  by High Judge of PTA Yogyakarta, Drs. H. Mansur, was answered by Fadlil Sumadi. Manshur admired the publication of the Constitutional Court decision that could be publicly accessible via website immediately after the verdict was read of.

According to Fadlil Sumadi, who since the establishment of the Constitutional Court as the Court registrar has been one of pioneers of the publication system of the Court, court decision which can be accessed quickly is a necessity for the Constitutional considering the urgency of decision that  becomes binding law at the time of the decision was read of.

The meeting of PTA Yogyakarta delegation with the Chairman of the Constitutional Court ended at 15:00 pm, ended with souvenirs giving submitted by Chairman of High Religious Court of Yogyakarta to the Chairman of the Constitutional Court, followed with taking pictures together.
