Judge Freedom in Perspective of Freedom Frans Magnis-Suseno’s Philosophy Its Relevance for the Development of Indonesian Judge

Yogyakarta, pta-yogyakarta.go.id Friday (05/03/10) - On March 5, 2010 Deputy Chairman of the Supreme Court for Non-judicial Matters had completed his doctoral study in multidisciplinary knowledge with cum laude predicate. On the sidelines of his busyness he took to continue his studies at the Doctoral Program of postgraduate School of Gajah Mada University, Yogyakarta and completed his research which he set forth in the form of a dissertation titled "Judge’s Freedom in The Perspective of Freedom Philosophy of Frans Magnis-Suseno Its Relevance for the Development of Indonesian Judge".

He Defended his dissertation in the front of the Open Session of the Board of Examiners in the School of TPA with the examiners team consisting of:

One of Ahmad Kamil’s mottos in his dissertation is: The judge is ulil Albab philosopher who always thinks of all the phenomena to achieve the glory of the world and the hereafter. The motto was reflected in the Ahmad Kamil’s answer responding to a question from a Board of Examiners about his interest as a legal practitioner in entering the realm of philosophy. Ahmad Kamil said that expectation of these studies was that the judge in the decision to have a philosophical justice. "If the verdict contains philosophical justice, there will be a normative justice, because justice is part of the normative ethical philosophy," said Ahmad Kamil.

According to Ahmad Kamil as the main actor in the judicial process, judge is demanded to sharpen the conscience, to maintain ahlaqul karimah (noble morals), to improve the skills of professionalism in upholding law and justice for the prosperity and tranquility in the society.

His restlessness of mind and conscience while seeing of several court decisions that have blasphemy, resistance, even not  least  that can not be executed as if the judge’s verdict was far from the law values and justice sense of society, has motivated him to write a philosophical dissertation on the freedom of judge in determining decision which is a form of freedom and independence of the judiciary.

Departing from it, in determining the ontological foundation in meaning of freedom judges Ahmad Kamil tried to understand Magniz-Suseno’s thought about the philosophy of freedom that has been elaborated with the ideals and character of Indonesia, with the ultimate goal of dissertation is to give an epistemology reference to Indonesian Supreme Court in conducting policy for developing judge’s freedom as a system of philosophic thought to bear the nobility and grandeur of Indonesian judges’ dignity.

Ahmad Kamil’s graduation was attended by the Chairman of the Supreme Court, Harifin A. Tumpa and also former Chairman of the Supreme Court, Bagir Manan. During Bagir Manan had been an incumbent Chief Justice, Ahmad Kamil began his doctoral study that he eventually finished in three years. So no wonder in his dissertation, Ahmad Kamil specifically thanked and paid homage to Bagir Manan and Harifin A. Tumpa who always provided motivation and support to him in taking on his doctoral study.
