THE HISTORY OF YOGYAKARTA HIGH RELIGIOUS COURT

1. HISTORY OF THE PROVINCE OF SPECIAL REGION OF YOGYAKARTA

Special Region of Yogyakarta is a province-level autonomous region headed by Sri Sultan Hamengkubuwono IX as the regional head of DIY and Sri Paku Alam VIII as the Deputy Regional Head of DIY. The law that established the Special Region of Yogyakarta as the province-level autonomous region was Law Num. 3 jo 19 in 1950, while that put Kasunanan enclave areas in Bantul and Mangkunegaran enclave area in Gunung Kidul into Regency of Yogyakarta Special Region was Law Num.14 in 1958.

A BRIEF HISTORY OF THE RELIGIOUS COURT

I.            PRE - 1882

The discussion on chronological sequence about both the existence and the role of Religious Court is necessarily needed since the need to shape a better future of the Court is crucial. However, the lack of data on Religious Court within this archipelago has created difficulties in presenting appropriate information about the issue. The scarcity of written sources could be caused by the reluctance of influentially educated people to pay much attention to the issue of Religious Court. Aceh is one of kesultanan (kingdom) where Syekh Nuruddin Ar-Raniri through his writing on history did not widely discuss religious law practiced by local people. This fact showed that the attention to religious law, theoretically and practically was not significantly paid.

15 January: Senior Supreme Court judge Harifin A Tumpa was elected today as Indonesia's new Supreme Court Chief Justice.

10 October: On Tuesday 7 October, Jimly Asshiddiqie resigned as Chief Justice of Indonesia's Constitutional Court. Although Jimly was not without his critics - including those who disapproved of his rather public aspirations to become involved in politics - he has undoubtedly made a very positive and significant contribution to Indonesian legal and judicial reform. In the wake of Soeharto's downfall, a number of institutions sprung up - including the Ombudsman, the Judicial Commission, the Anti-Corruption Commission and the Constitutional Court. Other institutions, such as the Supreme Court, were subject to significant reform. It is probably fair to say, though, that most of these new institutions, and the reforms of older ones, have not been entirely successful.

Legal System/History

Indonesian legal system based on Roman-Dutch law, custom and Islamic law. Most of archipelago was under Dutch rule by start of 20th century.

Under Dutch Netherlands Indies population was divided into Europeans, Natives, and Foreign Orientals; established separate tribunals for Europeans and Natives. Indonesians subject to adat law, with Netherlands East Indies divided into several jurisdictions based on cultural and linguistic criteria. Basic principle was dominance of the received civil law system, and application of adat for natives as far as it was not replaced by statute. First legislation relating to application of Islamic law was 1882 Royal Decree establishing a Priest Court in Java and Madura, with jurisdiction over Muslim family and inheritance law where all parties were Muslim and awqaf. Independence declared two days after Japanese occupying forces withdrew in 1945. Only statutory reform of Muslim personal status law in that period was enactment of Muslim Marriage and Divorce Registration Law 1946 requiring registration. New Marriage Law applicable to all Indonesians eventually passed in 1974 amidst much controversy. Marriage Law is applied by regular court system for religious minorities and by sharia courts for Muslim Indonesians. Compilations on Islamic law issued by Ministry of Religion and Supreme Court judges since mid-1980s to clarify points of Islamic law for application in sharia courts.

ANCIENT INDONESIA

The first people in Indonesia arrived about 40,000 years ago when sea level was lower and it was joined to Asia by a land bridge. Then at the end of the last ice age about 10,000 BC a new wave of people came. At first they hunted animals, collected shellfish and gathered plants for food. By about 2,500 BC they learned to grow crops such as taro, bananas, millet and rice. The early farmers also made pottery but all their tools were made of stone.
