Steps that an appellant must take and know when filing an appeal:


1. An appeal application must be filed written or orally to the religious court within:
  • 1.     14 days effective the following day from the day the judgment is passed or the day the judgment is officially and legally notified to the appellee.

  • 2.     30 days for appellants residing outside the jurisdiction of the religious court that made the judgment (Article 7 Law No. 20/1974).

2. Paying the appeal fee.

3. The registrar notifies the appellee of the case being appealed.

4. The appellant may file a Notice of Appeal (Appeal Memory) and the Appellee may file a Contra Notice of Appeal (Appeal Contra Memory).

5. 14 days after the appeal application is notified to the Appellee both parties are given the time to examine the dossier of the case at the religious court.
The dossier of the appeal case is submitted to the Appellate Religious Court within one month at most since the appeal case is registered.

6. A copy of the appeal judgment is submitted by the High Religious Court to the religious court with order to notify both parties of the judgment.

7. The religious court delivers copies of the judgment to both parties.

8. After the appeal judgment has a final and binding force, the registrar then:

 a. For a divorce case filed by a husband:
  • 1) Informs the day and date of witnessing session of divorce decree and summons both parties (appellant and appellee).
  • 2) Provides certificates of divorce as official proof of divorce within 7 days at most.
  b. For a divorce case filed by a wife:
  • Provides certificates of divorce as official proof of divorce within 7 days at most.

 

APPEAL CASE FINALIZING PROCESS

1. The dossier of appeal case is listed and registered with a particular number.

2. The Chief of the High Religious Court decides a panel of judges who will examine the case.

3. The Registrar of the High Religious Court decides a substitute registrar who will help the panel of judges.

4. The substitute registrar hands over the dossier of the appeal case to the chief panel of judges.

5. The substitute registrar distributes the dossier to the other members of panel of judges.

6. The panel of high religious court judges makes a decision (Judgment).

7. A copy of the judgment is submitted to both parties through the religious court.
